If you never had the need to look for an eminent domain law firm before, finding one can seem like a daunting task. There are several key attributes that capable eminent domain law firms in California should possess. Knowing these can help you narrow down the list of firms that may come up during your search. Consider these top 3 criteria when determining which eminent domain attorney to hire:

1. Experience

Consider the following questions when calculating the level of experience an attorney has:

1. How many eminent domain cases have they handled?
2. How many eminent domain cases have they taken to trial?
3. How many eminent domain cases have they handled on the appellate and State Supreme Court level?
4. What types of properties have they handled?
5. What types of issues have they dealt with?
6. Which states have they taken cases?

Question your potential attorney, and have them review your appraisal and conduct a case evaluation. An experienced eminent domain attorney will accurately assess and explain your damages and, in most cases, estimate the amount owed to you.

You should know that only a small percentage of eminent domain cases go to trial, and when an attorney takes your case, they won’t know whether or not it will proceed to trial. However, a good eminent domain attorney will plan their strategy around going to trial and will therefore be prepared in the event that this occurs. If your case goes to trial, does your attorney have the experience necessary to persuade a judge and jury? Are they planning appropriately and are they willing to go to trial?

2. Are They Looking Out for my Best Interest?

Hiring an attorney who works both sides can result in a conflict of interest scenario; the attorney has worked for the government in the past and/or is friendly with the condemning authority’s attorney. There are many good attorneys who represent both the condemning authority and the property owner, so be aware of this situation and decide whether or not you are comfortable with it before hiring an attorney.

Keep in mind that hiring a local attorney who has only handled a few eminent domain cases can result in a similar situation. This attorney might have ties to the local government, which could put undue pressure on this attorney to settle the case.

3 – Set Expectations

In addition to understanding the issues surrounding your case, you should know how much money you are entitled to receive. A knowledgeable eminent domain attorney will discuss their strategy with you; tell you how much money they are pursuing and what the estimated final award of damages will be. If you expect your attorney to take your case to trial, then make sure you hire a trial lawyer.

Lastly, whether or not you hire an attorney to challenge the government’s right to take, to pursue an inverse condemnation claim, or to pursue additional damages, you should know that in some states, attorneys fees and costs could be paid for by the government. Read more about eminent domain and the eminent domain laws in your state.

The attorneys at Oliver, Sandifer, & Murphy are highly accomplished trial lawyers and determined negotiators whose practice is exclusively focused on all aspects of eminent domain, California easement, and condemnation proceedings. They are recognized as the premier California eminent domain firm, and are credited with having the knowledge, experience, resources, and determination to vigorously represent our clients in all eminent domain and condemnation matters.

Property management law includes the rules regarding the different forms of ownership. There are mainly two forms of ownership that is freehold estate ownership and concurrent estate ownership. Freehold ownership is further sub divided into various categories, among them the largest estate that is permitted by law is the fee simple absolute. The holder of these estates has full possessory rights. The other estate ownership is the concurrent estate; this is also further divided into tenancy in common, joint tenancy and tenancy by the entirely. The law specifies the survivorship right of each of these estates.

The law also consists of the terms and conditions related to the leasehold property. To understand the law related to leaseholds you first need to take into consideration the two main things the type of tenancies and rent regulations. There are different types of tenancies like periodic tenancy, tenancy at will, tenancy for years, holdover tenant and statute of frauds. The law varies for different types of tenancies. Property management law also includes rent regulations but they differ according to the states and cities.

Acquiring title is the important part of the property management law. Real estate mainly includes purchase and sale of the property with the help of real estate agencies. Therefore they mainly enter into the contract; the rules regarding the contract are also included in the law. The contract must be signed and be in written, is compulsory under the law. An agreement is signed between you and the agency. There are different types of agreements such as non-exclusive agreement, exclusive agency agreement, exclusive right to sell, multiple listing and net listing. The rules regarding all these agreements are governed under the property management law.

The contract is very important and the first step if the property is sold. Therefore the contract consists of the rights and liabilities of the seller and purchaser both. Therefore the law mainly includes the procedure, formalities and transfers that are to be followed. The law for these contracts varies according to the state and cities. These are some of the things that you should know to understand the property management law.

Estate planning is what a person engages in while they are making out a last will and testament. They determine what will happen to all of the assets they own and who will benefit from such assets. Therefore, estate planning is extremely important, if you want to leave specific individuals your assets, like your home, your vehicle(s) or any form of money, you will need to write a legal will and indicate your selected beneficiaries. There are several steps you will need to take in order to cover all the bases.

Next, you will need to speak to a lawyer that handles wills and estates about writing up your will. A lawyer can assist you with all the legalities and can advise you of what you can and cannot do in terms of planning the distribution of your assets. You can find a lawyer easily enough using your telephone directory or you can find one on the Internet.

Illinois estate planning attorney, Christopher D. Dwyer, operates one of the premier estate law firms in Chicago area as an asset protection attorney with a concentration on business counseling, wills, trusts and probate. Chris now owns and runs his own law firm and is dedicated to providing personal service with the same degree of expertise that he employed at the large Chicago estate law firms. He is personally invested in his clients’ success and provides a hands-on approach to each client’s legal needs. He understands both the legal and personal aspects of your business affairs. His clients come from all walks of life, throughout the state of Illinois, across the nation and around the world.

After you have located a lawyer, you will sit down with the attorney and go through any documentation pertaining to your assets. At this time, you may also want to consider the possibility of creating a Power of Attorney, a statement giving control of your assets to your pre-selected individual if something should happen to you while you are still living and you, for whatever reason, cannot speak for yourself. Also, you may want to consider creating a Health Care Proxy, letting whoever is in charge when you can’t be, decide the type of hospital treatment you would prefer.

Finally, during the process of creating a will, you may want to establish one or more trust funds, referred to as “discretionary trusts” to those individuals that may be too young to manage any assets you give them in the event of your death.

Millions of beneficiaries are there in real estate field. It is important to have the basic knowledge of real estate laws for a better success in this field.

Do you think that real estate laws are only meant for real estate attorneys and real estate brokers?

You will be loosing much income because of the ignorance. So keep awake and arise. Even a short course on basic of real estate laws or a pocket book will help you much.

How people like you get a hint of what is real estate law?

You need to know the basic legal procedures for smooth transactions and transfer of the ownerships of the property you purchase or sell. You should know about the stamp duties to be paid and the fee structures related to the title documentations and approvals. Many cases in which the investor lost much amount due to his ignorance about the fees to be paid during the process.

There are some real estate laws pertaining to the tenants. You should be aware of these laws if you want to rent out your property to some tenants.

Most of us always depend on mortgage loans for the investments in real estate. If you want to know the way the mortgage loans are treated in real estate laws, you require a basic understanding of it.

The laws clearly distinguish between commercial and residential properties. To understand clearly the classification of the properties, you require the basic knowledge of the real estate laws.

The basic knowledge will help you to have meaningful dialogues with real estate attorneys and brokers, when the need arises.

Do not spend much time!

How people should have simple basics of the real estate laws and you should leave the in depth analysis and intricacies to real estate attorneys and brokers. These personnel are well trained in the aspect of real estate laws.

If you spend more time on these aspects, you will end up with lack of time and also will loose concentration in the prime area of investment.

The real estate laws in different states are different even though the basics remain same. So be careful in inferring legal points when you deal with different states.

According to the changed policies of federal government and states, ten real estate laws can change over the period of time, especially the laws dealing with the fees and duties. So you have to get updated your knowledge continuously.

Real Estate also called immovable property includes the ownership and possession of land along with anything permanently affixed to that land such as buildings, garages, improvements and buildings. Substances that are beneath the land (such as gas, oil, minerals) are also considered permanently attached. However, other items, which can be attached to the land, but are not permanent, such as mobile homes and tool sheds, are not considered to be real property.

Real estate is often considered synonymous with real property as opposed to personal property, which includes all other property and is also called realty.

Real estate is one of the oldest areas of law and contains many archaic terms and concepts. Many consumers find the unfamiliar terms used in the real estate game trifling confusing when they enter the realty market. However, today we find that many of the rights and responsibilities regarding real estate have evolved and been updated as society has changed.

Owning real property – The real estate law says that when you own property, Intellectual Property, you have the right to do whatever you want with the land, except what is restricted by the real estate law. You have the right to use the land, rent or lease it, sell or transfer it, use it as collateral for a loan, bequeath it to a beneficiary or even just gift it away. You could also let it sit idle but in some cases, this may infringe on laws imposed by the state.

There exist some restrictions imposed by real estate law on owning real property. Although, on one hand, it is said that one can do whatever one wants if he owns the property, there are some restrictions imposed by the government – federal, state, country and local law enforcement agencies. Violation of the real estate law can result in hefty fines, penalties, injunctions and in some cases even criminal prosecution. The three most common restrictions are:

Zoning- Zoning laws restrict the use of the property with regards to residential, industrial, agricultural or commercial purposes. The size and height of improvements attached to the property are also subject to restriction. Environmental Hazards- This informs you of what materials can be stored on the real property as well as who is responsible for removing environmental hazards from real property. These would include government-regulated materials such as asbestos, lead paint, petro-chemicals, radon and toxic wastes. Public Easement and Right of Way- Some portion of the real property will have to be left open for others to use. Easements and right of way are used to allow access to other property to provide for roads and sidewalks as well as to enable electric/gas/telephone/sewer lines to be installed. Besides the above-mentioned restrictions, there are also some non-governmental restrictions like those of private parties that may be imposed on the use of your real estate property. For instance a real estate developer will have to decide on lot sizes, architectural design and vehicle parking subject to conditions put up in the purchase contract. The results for violation of private party agreements include an award of damages against the violator and injunctive relief.

In addition to the rights that you attain by owning real estate property, there are also several responsibilities and potential liabilities to others which result through ownership of real property.

You may own property subject to a mortgage. However, if you fail to pay the mortgage, the lender will take the property back A lien for payment of a debt can be placed against your property. If someone is injured on your property, you may be held liable to the injured person for all damages resulting from your negligence.
