Family law is the general classification assigned to the multiple areas of legal practice that cover domestic relations. This includes a wide variety of topics and issues, from marriage and divorce to adoption and surrogacy. Below are the main points of emphasis in family law.

Entering into marriage – A marriage is not only a sacred vow made between man and wife before God; it is also a legally binding contract. It states that two people are agreeing to share every part of their lives together, including finances, debts, properties, and parenting responsibilities. Some couples make the decision to sign a prenuptial agreement, which preemptively determines how assets will be divided in the event the marriage does not last.

Dissolution of marriage – As unpleasant as it is, the fact remains that nearly 50% of all marriages in the United States end in divorce. Therefore there exists an entire set of laws governing the ensuring complications, such as alimony, division of property and assets, child custody and child support. There are two main ways to dissolve a marriage: annulment and divorce. An annulment retroactively declares a marriage null and void, as though it never took place. The prerequisites to qualify for an annulment, such as insanity and fraud, vary from to state to state. A divorce is the final termination of a marriage contract, which cancels the legal obligations and bond of matrimony between two people.

Child Issues – Understandably, either the beginning or the end of a marriage can greatly affect the lives of any children involved. Issues include, but are not limited to, custody, support, paternity, adoption, abuse, abduction and foster care.

There is also another subdivision of family law devoted to the concerns of unmarried couples, such as common law marriages and same sex partnerships. These laws also vary greatly from state to state. From Florida to California, Miami to Stockton, lawyer firms specializing in family law can help you navigate these turbulent and confusing waters.

Tampa divorce attorneys at the law offices of Carey & Millison, P.A is distinguished in the practice of Marital, Family and Civil Law as well as Family and Civil Mediation. Their Tampa Bay law firm represents clients and their families throughout Florida, including Hillsborough, Pinellas, Pasco, Polk, Hernando, Manatee and Sarasota Counties. Their attorneys provide a full scope of legal services in all aspects of Family Law – paternity, divorce, alimony, child support, child custody, visitation and domestic violence actions as well as premarital and post-marital agreements.

Utilizing more than 60 years of combined experience and specialized knowledge in marital and family law, their attorneys are highly skilled in helping you effectively accomplish what is best for you and your family. If you are facing a divorce, or need compassionate mediation services or require trusted legal advice concerning other marital, family law or civil matters, you may call their law firm to arrange an appointment with one of their attorneys.

Intellectual property, although intangible, is still ownable and your intellectual property rights should be protected. An intellectual property lawyer who is trained to help reclaim patent, trademark, copyright and trade secret rights can help protect your intellectual property. Types of intellectual property include patents, trademarks and trade dress, copyrights, and trade secrets.

Patents

A patent is granted by the government allowing a (usually) 20 year monopoly on an invention previously “not generally known.” Patents are intended to encourage investment in research and development. If you create a new useful process for doing something, a machine, manufacture, or even an improvement on something already in existence, you can patent your invention and prohibit others from “making, using, offering for sale, or selling…or importing” the invention in the U.S. Your right to patent your invention is a constitutional right.

Patent lawyers will research previously granted patents for you to see if a similar product has already been patented or whether you should apply for a patent for your invention. A patent attorney will also tell you if your idea is not patentable because it is a law of nature, a physical phenomena, or abstract. You should find a specialized patent or intellectual property attorney because in order to prosecute a client’s patent application, he or she must be registered with the U.S. patent office. A patent lawyer will also have to have passed a science and engineering exam to better understand and serve clients.

Trademarks

Trademarks are granted for words, names, symbols, or devices which separate and distinguish businesses and services. These include arbitrary names such as Kodak, suggestive names such as Caterpillar (tractors), descriptive names which indicated the business’ products or services, and generic names which are descriptive. Generic and some descriptive names cannot be protected, so a trademark or intellectual property lawyer should be consulted to see if your name qualifies for trademark rights.

Trademark lawyers can also be sought to make sure that your new business isn’t using a registered mark. The consequences for using a registered mark, even though you may have put money and advertising into promoting your business, include being sued for infringement.

Copyrights

Copyrights protect the individual’s expression of an idea, but do not protect the idea itself (see patent). Copyrights are intended to promote scientific progress. If you come up with an idea or invention while working for a company, it is able to be patented or trademarked by the company you work for, but copyrightable work belongs to you, the employee, not the company employing you. However, there are loopholes, and an intellectual property lawyer will help you both with the process of getting your expression copyrighted but will also save you trouble and time in getting over road blocks.

If you are a company, you need an intellectual property lawyer who specializes in copyrights because especially with internet businesses, you will need to make sure that contractually your web site design can be copyrighted to your company and will not belong to the employee or independent contractor who created it. This also applies to software.

Trade Secrets

It is important to protect your business’ trade secrets so they will not be misappropriated. Whereas patents have a limited time of coverage and after 20 years are released, trade secrets are always protected. To qualify as a trade secret, it must have independent economic value to the company.

Orange County intellectual property lawyers at Klein & Wilson are the top trial attorneys in Orange County, California, with extensive experience in representing plaintiffs and defendants in trademark infringement, trade secret, unfair competition claims, intellectual property and copyright infringement claims.

Criminal law is one of the most common types of law practiced in the United States. People make mistakes, and when these mistakes involve the law, it is absolutely critical that if you find yourself on the wrong side of the law you have the best lawyer at your side to help you protect your rights and freedom. One of the most common infractions that people find themselves involved with is the child abuse law.

Child abuse is a very unfortunate crime and is a pretty sensitive and serious assault. This crime has something to do with mistreatment of children physically, mentally, psychologically and sexually. This results in physical, mental illness of a child and can possibly result to death. Physical abuse of a child involves beating, burning, shaking etc., which causes serious injury to the child. Toxin transmission through the mother to child can also be considered as physical abuse which results in serious consequence to the child.

Another kind of child abuse which also comes under the category of psychological abuse is verbal / emotional abuse. Verbal / emotional abuse is caused as a result of insulting, shouting / yelling, de motivating and demoralizing. This kind of abuse can result in mental illness of a child and can also result in serious depression and as a result of these incidents could also lead to death. This usually happens when one child is compared with another regarding their skills, capabilities, performance etc.

Shouting / yelling at a child will result in losing their self confidence and also will let them think of their own capabilities even when they know that they are doing better according to their capabilities. In the longer run, these will definitely result in health disorders and badly affects the child growth and also as they grow to become teenagers, it will result in addiction to alcohol and drugs. “Neglect” is another kind of child abuse which results in irresponsibility from the adults in taking care of their children. This child abuse is also a result of lack of love and affection towards the child, failing to provide medication when children are ill and so on. With this, there is a huge chance of children not respecting their parents when they grow up, and can result in serious damage of the relationships between the parent and the child. Criminal lawyers and family lawyers can deal these kinds of cases and are pretty helpful in providing right justice as well.

If you or your loved ones ever face criminal charges, there’s no doubt that you will experience a tremendous amount of anxiety. And, in the midst of your distress, you’ll need to select a criminal defense attorney. There are many things to consider when hiring a Florida criminal attorney. The following is a list of some of the things that you should consider when hiring a Florida criminal lawyer:

1. Be certain that the attorney you intend to hire actually handles criminal cases. Don’t hire your divorce lawyer or the lawyer who drew up your will to handle your criminal case. You wouldn’t hire a brain surgeon to operate on your heart would you? Because criminal defense is a specialized field of law, you need to hire a lawyer who specializes in this particular field.

2. Be certain that the Florida criminal lawyer you intend to hire handles the particular type of criminal case that you have. If you are charged with murder, don’t hire a lawyer who does only drunk-driving cases. Find a lawyer instead who has experience handling murder cases. Or if you are charged with a federal crime, don’t hire a Florida lawyer who handles crimes only in state court. Find a lawyer instead who has experience handling federal cases.

3. Be certain that the Florida criminal lawyer you intend to hire has a lot of experience handling your particular type of case. For example, even if the lawyer you intend to hire handles nothing but drunk-driving cases, did he or she graduate from law school three months ago and therefore has very little actual experience handling such cases?

4. Avoid hiring a Florida criminal attorney who promises you a specific outcome. It is impossible for a lawyer whom you have just met and who knows nothing about your case except what you have told him to tell you how your case will turn out with any degree of certainty.

5. If you are hiring a specific Florida criminal lawyer to work on your case, make sure that that specific lawyer and not one of her associates is the lawyer who will actually be working on your case and going to court with you.

6. Hire a Florida criminal attorney whom you feel comfortable working with after meeting him and discussing your case. Don’t hire a lawyer who is pressuring you to go to trial if your goal is to strike a satisfactory deal with the prosecutor as soon as possible. On the other hand, don’t hire a lawyer who is pressuring you to take a plea bargain if what you really want is a trial.

7. Be certain that the Florida criminal attorney you intend to hire has a support staff that can adequately handle your case. Does the lawyer have, for example, a secretary, an investigator, a paralegal, and access to expert witnesses that may be needed in order to properly represent you at trial? If not, you may want to look for another lawyer.

8. If the Florida criminal lawyer you intend to hire is quoting you a fee that is a lot more or a lot less than the going rate, ask yourself why. If the fee being quoted is a lot more than the going rate, is it because the lawyer is that much better than her competitors? If she is not that much better, than why should you pay that fee? On the other hand, if the fee being quoted is a lot less than the going rate, is it because the lawyer is just starting out and has little experience handling your particular type of criminal case? If so, you may want to look for another lawyer.

Founded in 2001, Dedicated to criminal defense in Orlando, Carsten & Ladan, P.A. protects the rights of clients throughout central Florida. With over 40 years combined experience with Orlando criminal laws, they offer knowledgeable and aggressive defense counsel to individuals needing representation for misdemeanor and felony crimes, including Orlando DUI.

A Miami criminal lawyer will educate you about what should be said, and more importantly, what not to say. The primary aim of the Miami criminal lawyer would be to first ensure that the case does not reach the court.

On the other hand if the case does reach the courts, a Miami criminal lawyer is with you every step of the way. Hence the Miami criminal lawyer, who has been through such situations many a times in the past, would be a better guide. Incase you are sucked into such an unfortunate situation and to top it all, the overzealous police personnel try to bully you into submission, do the right thing. Ensure that you ask for your lawyer even before the interrogation begins.

There are innumerable people who seek assistance of a Miami criminal lawyer in cases ranging from drug charges, DUI, DWI, murder and battery. Miami criminal lawyer have helped residents escape or reduce punishment in cases of white collar crimes. These include insurance fraud involvement, possession of forged notes, etc most of which were due to the presence or mere relation of the accused with the people perpetrating the frauds. Most of the times we don’t realize that what we consider an act of kindness or good faith may be misconstrued in the court of law by spiteful partners or jealous competitors into scandals and scams. Though in our hearts we have done no wrong but there is manner and method in which the same has to be represented in the court, with correct logic and situations narrations, a Miami criminal lawyer would do exactly that is needed.

The choice of Miami criminal lawyer may not be that simple, just anyone who knows law or has a degree in law may not be the best lawyer to represent you in court. When it is a matter of life and death, careers, pride and personal freedom is at stake, one should look at only specialist. You should be looking at only criminal lawyers, who have fought and won cases in the area of work that you need help in. One way of getting the names is through references, the other through internet searches. The years of experience is definitely relevant however, what matters the most, is the attention to detail and never say die attitude. In case you have marked out a Miami criminal lawyer, a personal meeting is essential to set the expectations right.

Estate planning is the process of organizing the distribution of one’s assets to their heirs or beneficiaries. This is especially considered when an individual wishes to provide legal rights of his or her property in the event that he or she dies. Family members, friends, business partners or even an anonymous third party person can be entitled to become an heir or a beneficiary.

There are things that are important for the success of estate planning. One thing involve in this undertaking is the search for the best estate planning lawyer. Consulting an estate-planning lawyer entails not only with manufacturing a will but also ensuring that the client’s requests regarding his or her property distribution would be granted upon death.

Furthermore, an estate-planning lawyer will do more than just establishing a client’s legal will because in the process of doing so, he or she must also be adept at minimizing taxes and fees associated with personal or real property. A contingency plan should also be set up in case unwanted events like family or legal disputes arise. Other aspects that an estate-planning lawyer will deal with involve trusts, uniform probate code, gift tax, dynasty trust as well as joint tenancy.

Besides just giving assistance to an individual’s will, an estate-planning lawyer can also help you with organizing any personal or business records like brokerage accounts, retirement plans, savings accounts, checking accounts, insurance, business interests, and even debt personal property. Any miscellaneous legal planning involved in the process of planning an estate is a concern and part of the duty of an employed estate-planning lawyer.

Now, when you look for an estate-planning lawyer you must consider first of all his or her educational background and work experience. The best estate-planning lawyer must be very educated and experienced particularly in the field of estate planning and strategies. It is imperative that your estate-planning lawyer is familiar with state laws since each state has varying laws when it comes to wealth distribution. Moreover, he or she must have excellent knowledge on how to get rid of excessive probate or estate tax while keeping himself or herself up to date with the ever-changing tax and estate laws.

The lawyers of Delzer, Coulter & Bell offer legal services focusing on wills, elder law, estate planning and litigation in Pasco County.

Throughout Florida, there are excellent attorneys who specialize in the dissolution of marriage and they can help individuals know how to begin the proceedings. An attorney will understand which paperwork is necessary to begin the process. They also know when and where the forms and documents are to be submitted. They can also help explain any legal terms or phrases which may be difficult for someone to understand, as they sort through and complete the lengthy forms. Basically, an attorney should be available to walk their client through the process.

Additionally, attorneys are essential when it comes to offering representation during mediation. Good representation is often the key to a smooth mediation process. An attorney can also be useful in pre-mediation discussion, helping separating couples achieve a harmonious solution. They can be the objective third-party, offering suggestions for peaceful solution. They can also be the clear-headed voice of reason when tempers flare. Attorneys may be able to present ideas or arrangements which they have seen work successfully during past cases. They can bring a valued perspective to the negotiation table.

Attorneys can also work closely with other professionals who may be involved in separation proceedings. Perhaps that may be marriage counselors, who have offered their services in attempt to reconcile the couple. Perhaps it may be children’s services or law enforcement officials, if one of the separating parties has committed acts which are of danger to anyone in the family. A good attorney will collect input from all involved sources and be able to present that information to a judge if it is found to be necessary.

The bottom line is that Florida residents will experience some of the same joys and hardships facing all Americans throughout the other forty-nine states. For the couple who is separating, there are many things to consider as they go about the separation process. The individual who consults and follows the advice of an attorney who specializes in the dissolution of marriages will be better able to take control of the future.

Certainly nobody likes to think about waking up one day and finding themselves in need of a criminal attorney but if it happens it’s good to know that the residents of south Florida have choices. From the Fort Lauderdale attorney, Miami attorney, to West Palm Beach criminal lawyer, the southern areas of Florida have many excellent lawyers to take care of you if and when you ever need their assistance.

A well-educated attorney can make bad decisions that somebody made be less painful when it comes to trial and sentencing. It is the criminal attorney’s job to support the innocents of the client and to make the job of the prosecutor more difficult. The burden of proof falls on the prosecutor and they must prove the clients guilt while the attorney supports the clients’ innocents. Ultimately the client puts his life in the hands of his criminal attorney and that is why it’s very important to make sure one has the best criminal lawyer you can get.

It is a misconception that criminal attorneys only have clients that are of the most deviant of offenders. This is not true. Certainly those accused of crimes such as murder, robbery, and rape need the assistance of a criminal lawyer but also those accused of white-collar crimes in business need the assistant of a knowledgeable criminal attorney as well. A good percentage of clients who seek the help of a criminal attorney are those who are accused of white-collar crimes such as business executive and those in the stock market.

There are many high profile cases that are spotlighted by the media; many criminal attorneys have made a name for themselves when representing one of these high profile cases. This is when a criminal attorney needs to have all his ducks in a row because all eyes are on him/her to see how he/she will represent the client and if he or she will win. Not all criminal attorneys like or even want a high profile case because they tend to be rather difficult cases. Being in the spotlight doesn’t always work well for the defense.

It is safe to say that should you ever need an attorney you will want to get the very best in the business. If you need a criminal lawyer your life is on the line; a good attorney will help you get back your life. If you are charged with a drug crime in Miami, you need a criminal law attorney with broad experience in defending drug cases. Brent Horst is a Miami-Dade County criminal lawyer with a wide range of qualifications in this area of the law:

* He has a track record and experience defending over 200 Miami felonies in jury trials.
* As a former prosecutor and Assistant State Attorney, he has experience with the criminal justice system. He knows how the process works, how to attack the case presented by the state, how to challenge government evidence, and how to negotiate on your behalf.

Located in Miami Mr. Horst provides services for clients charged with drug crimes throughout Florida including Miami, Fort Lauderdale, Tampa, Clearwater, Jacksonville, and Orlando.

You need to utilize the services of a medical malpractice lawyer if you or someone you care for has been injured, even temporarily, by the negligence of a doctor or hospital. Pursuing a case of medical malpractice without the assistance and help of a qualified lawyer is really going to only be an exercise in futility for you, as you will very quickly find out.

The role of a qualified and good medical malpractice lawyer would be to find out the details of the case. The lawyer has had a great deal of experience with this type of case and is fully aware of what needs to be proved, what needs to be demonstrated, and what data needs to be gathered. After all this has been done, the lawyer can make an informed and educated recommendation to you as to whether or not you really have a malpractice case and whether or not it is worthwhile to move forward with it.

If you are worried about the fees that the medical malpractice lawyer will charge you, this should not be a concern at all. In most cases, the lawyer will take a percentage of the award that you are given as a result of the case being won, instead of charging you legal fees separately. This makes a great deal of sense for the lawyer since if he does not win the case, he does not get paid for all his time that he invested in it, so he has a greater incentive to win the case and offer you his best advice about the case.

Make sure that you feel comfortable with the lawyer you choose. You should feel like you are able to talk openly with him or her, and also feel comfortable that they have the experience under their belt to be able to represent you and win the case. If you do not feel comfortable, you can always find another lawyer.

Another advantage to using a medical malpractice lawyer is that they know the law and they know how to present the case. In that situation, as opposed to you representing yourself, the majority of malpractice cases are settled out of court. This is quick and easy for the doctor or hospital, it does not cause the case to drag on through the legal system for weeks and even months, and also does not create a great deal of negative publicity for the doctor or hospital. But if you are representing yourself, it probably will not get settled out of court since they will assume you are not a legal expert and will push back as hard as they can.

If you or someone you love has been injured by malpractice, do not hesitate to talk with a good medical malpractice lawyer as soon as possible while the facts are still fresh in your mind, since you deserve compensation for what happened. Medical malpractice attorneys in Miami Florida, Glinn & Somera, P.A. focus on medical malpractice lawsuits protecting individuals & families from doctors, hospitals & health care providers.

The attorneys of Glinn & Somera, P.A. focus on protecting families from being victimized by the reckless behavior of some doctors and hospitals. They stand ready to make sure that you and your loved ones are protected, get justice and are fairly compensated for what was done to you. It will also help protect others from being victimized as well. Glinn & Somera looks forward to each case as a fresh challenge to get victims of medical malpractice the justice they seek and the compensation they deserve.

According to Florida bankruptcy law, a permanent resident of Florida can file bankruptcy in a Florida bankruptcy court. Florida has three bankruptcy courts, one in every bankruptcy district. They are Florida middle bankruptcy court, Florida northern bankruptcy court, and Florida southern bankruptcy court. All counties in Florida come under one of these bankruptcy courts. Bankruptcy has to be filed in the district of residence.

Most bankruptcy claims are personal claims that come under Chapter 7 and 13 of the federal bankruptcy law. Chapter 7 is also named liquidation or straight bankruptcy. Chapter 13 bankruptcy is known as a wage-earner plan. When a Chapter 7 or Chapter 13 bankruptcy is filed, a trustee takes all the non-exempt property and sells it for the benefit of the creditors. But exempted property cannot be taken. Florida bankruptcy laws make determinations regarding non-exempt and exempt property. If Florida bankruptcy laws render a person ineligible for any exemption, he is allowed to choose federal exemptions.

The new Florida bankruptcy law, effective from October 17, 2005, makes filing bankruptcy cases more complicated. It incorporates impediments to filing bankruptcy, new court rules, new forms, and additional work for debtors and attorneys. According to the new Florida bankruptcy law, the Florida exemption law is applicable to your bankruptcy only if you have resided for two years in Florida, immediately prior to the filing date. If not, in order to get exemption, most of the 180 days prior to those two years should be spent in Florida.

Bankruptcy may be the only solution for extreme financial hardship. At the end of the bankruptcy proceedings, the court discharges the borrower from the debts. The bankrupt person can start all over again with a clean financial slate, but a record of bankruptcy will remain on his credit profile for up to ten years.
